This Privacy Policy explains what information the Underwing platform ("Underwing," "we," "us") collects, how it is used and shared, how long it is kept, and the choices and rights you have. It applies to the Underwing app, the Underwing website chat that producers can place on their own websites, and any Underwing marketing site. Read it together with the Terms and Conditions, which control if the two conflict.

1. Who This Covers

• Producers. Insurance producers, agency principals, and agency staff who hold an Underwing account ("you").
• People producers work with. Clients, prospects, and other contacts whose information a producer chooses to put into Underwing, people who receive emails a producer sends through Underwing, and visitors who use a producer's Underwing website chat. For this information, the producer decides what to collect and why, and Underwing processes it on the producer's behalf as a service provider. Questions or requests about that information should go to the producer first; we will help the producer respond.

2. What We Collect

• Account information. Your name, email address, and sign-in credentials, managed through our authentication provider.
• Billing information. If you subscribe to a paid plan, your billing name, email, plan, and payment status. Card details are collected and stored by our payment processor, Stripe; Underwing does not receive or store full card numbers.
• Clone profile. Your questionnaire answers, writing samples, goals, profile text, and voice and style notes used to build your AI clone.
• Tool inputs and outputs. What you type, paste, upload (images, PDFs, and office files), or speak into the tools, and the drafts and replies the tools produce. Spoken input is turned into text by your browser's speech service before it reaches us.
• Information about your clients and contacts. Notes you record about people (for example family, occupation, recreation, and goals), lead notifications you forward to Underwing, and contact lists you upload for email campaigns.
• Practice and coaching records. Roleplay Coach practice calls, including the conversation transcript, the style and mood you chose, scores, sub-scores, and the coaching fix; Video Coach and The Connection Code scores; habit streaks; and goal-setting records.
• Assessment results. Your answers to The Connection Code and The Wiring Code and the resulting style profile.
• Self-reported results. Business outcomes you choose to log, such as appointments, quotes out, applications submitted, policies bound, and premium written, and your My Farm activity counts.
• Feedback. Producer Voice submissions, survey answers, and other messages you send us.
• Website chat visitors. If a producer adds the Underwing website chat to their site, the messages a visitor types and any name, email, or phone number the visitor chooses to give, which become a lead for that producer.
• Email delivery and engagement. For emails Underwing sends to you, and emails you send to your contacts through Email Campaigns: delivery status, bounces, complaints, unsubscribes, and whether a message was opened or a link was clicked.
• Usage and technical data. Which tools you use and when, AI usage against your allowance and its estimated cost, error and diagnostic logs, and the IP address and browser user agent recorded when you accept the Terms.

We ask you not to submit Social Security numbers, driver's license numbers, bank or card details, policy or claim numbers tied to a person, medical or health information, or other sensitive personal information about anyone (see Section 7 of the Terms). If you do, you are responsible for having the right to share it.

3. How We Use It

• To provide the platform: generate drafts and coaching in your voice, score and track practice, run the website chat and email features you turn on, and send the emails you have enabled.
• To bill paid plans, prevent fraud, and handle payment disputes.
• To keep the platform safe and working: enforce usage limits and the Terms, investigate misuse, debug failures, and maintain security.
• To keep records the law and the Terms require, such as which version of the Terms you accepted and when, and email unsubscribe lists.
• To improve Underwing's own prompts, features, and coaching, and to create aggregated or de-identified statistics that do not identify you or anyone else.
• To communicate with you about your account, changes to the Terms or this policy, and, with your consent where required, product news. You can turn off non-essential emails in the app.

4. Who Processes It

Underwing uses established third-party services that process data only as needed to provide the platform:

• Anthropic: the main AI model provider that processes tool inputs and your clone profile to produce drafts and coaching.
• OpenAI and Google (Gemini): backup AI processing, image generation, and video review, where those features are used.
• ElevenLabs and Fish Audio: speech synthesis for spoken replies and roleplay voices.
• Your browser's speech service: speech-to-text for the microphone and hands-free features. Some browsers send audio to their maker, such as Google or Apple, to transcribe it.
• Netlify: website and application hosting, including the serverless functions that run the tools.
• Supabase: authentication and the database that stores your account and platform records.
• Resend: email sending and receiving, including Email Campaigns, delivery and engagement tracking, and lead-forwarding.
• Stripe: payment processing for paid plans.
• Google Fonts: typefaces on the marketing and policy pages.

We may also disclose information when the law requires it, to protect the rights, safety, or property of Underwing, our users, or others, to enforce the Terms, or as part of a merger, acquisition, financing, or sale of all or part of our business, in which case this policy will continue to apply to the information transferred. We are not responsible for the privacy practices of third-party services you connect or link to yourself.

5. No Sale, No Ad Tracking

We do not sell personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined under California law. We do not run third-party advertising trackers or analytics pixels on the platform.

6. Your Content and AI Training

Underwing does not use your private content, clone profile, client notes, practice transcripts, or tool inputs to train generalized AI models, and does not authorize its AI providers to train their generalized models on that content, except as expressly disclosed and authorized by you. Content sent to AI providers is processed under their business API terms, which may allow limited retention for abuse monitoring.

7. Retention and Deletion

Account data, clone profile, practice and coaching records (including roleplay transcripts), and other platform records are kept while your account is active so the platform can show your progress and history. When your account is closed, or on your request, we delete your personal information within a commercially reasonable period, except:

• records we must keep by law or to establish, exercise, or defend legal claims, such as Terms acceptance records, billing and tax records, and email unsubscribe lists;
• aggregated or de-identified data that no longer identifies you; and
• residual copies in routine backups, which expire on their own schedule.

8. Security

We use administrative, technical, and organizational safeguards appropriate to the platform, including encrypted connections, access controls, and database row-level security. No system is perfectly secure, and we cannot guarantee the security of information you transmit. If a breach affects your personal information, we will notify you as required by law. You are responsible for keeping your password confidential.

9. Your Rights and Choices

Depending on where you live, including under the California Consumer Privacy Act, you may have the right to:

• know what personal information we have collected about you and how we use and share it, and get a copy;
• correct inaccurate information;
• delete your information, subject to the exceptions in Section 7;
• opt out of the sale or sharing of personal information (we do neither); and
• not be discriminated against for exercising these rights.

To make a request, email sam@samjohnsoncoach.com from the address on your account. We will verify your request before acting on it, and an authorized agent may make a request on your behalf with proof of authority. We will respond within the time the law requires. If you are a client, prospect, or website visitor of a producer, please contact that producer first.

10. Children

Underwing is for adults conducting business. It is not directed to anyone under 18, and we do not knowingly collect personal information from children. If you believe a child has provided information to us, contact us and we will delete it.

11. Where Data Is Processed

Underwing is operated from the United States, and our providers process data in the United States and other countries. By using the platform you understand that your information will be processed in the United States.

12. Do Not Track and Global Privacy Control

The platform does not respond to browser Do Not Track signals. Because we do not sell or share personal information, a Global Privacy Control signal does not change how we process your information; we treat it as an opt-out request where the law requires.

13. Changes to This Policy

If this policy changes materially, we will tell you through the platform or by email, and the effective date above will be updated. Continued use after a change takes effect means you accept the updated policy, to the extent permitted by law.
